1. สิทธิในการนำออกเผยแพร่ต่อสาธารณชน

•  เผยแพร่ในสถานประกอบการ เช่น ร้านอาหาร, ผับ, บาร์, ร้านคาราโอเกะ, โรงภาพยนตร์, โรงแรม, ฟิตเนส, ร้านค้า, ห้างสรรพสินค้า, สปา, โรงเรียนสอนเต้นรำ เป็นต้น

•  เผยแพร่เสียงแพร่ภาพทางวิทยุ-โทรทัศน์ เช่น สถานีโทรทัศน์(ฟรีทีวี), เคเบิ้ลทีวี, สถานีวิทยุ เป็นต้น

2. สิทธิเผยแพร่ทางระบบเทคโนโลยีไร้สาย หรือ โทรศัพท์เคลื่อนที่ แบ่งเป็น

• ริงโทน (Ringtone) หรือ เสียงเรียกเข้า แบ่งเป็น 3 รูปแบบ

- โมโนโฟนิค (Monophonic)
- โพลีโฟนิค (Polyphonic)
- ทรูโทน (Truetone)

• ริงแบคโทน (Ringback Tone) / Calling Melody / เสียงรอสาย

3 เผยแพร่ทางอินเตอร์เน็ต แบ่งเป็น

• Simulcasting หมายถึง การเผยแพร่เพลงทางวิทยุไปพร้อมกับอินเตอร์เน็ต

• Webcasting หมายถึง การส่งสัญญาณภาพและ/หรือเสียงงานอันมีลิขสิทธิ์ผ่านระบบอินเตอร์เน็ต โดยที่จุดหมายหลักของบริการของผู้รับอนุญาตคือ เพื่อจัดหาความบันเทิงให้แก่ผู้ใช้งานในเว็บไซต์ที่ได้รับอนุญาต และการทำ Webcasting นั้นกระทำโดยผู้รับอนุญาตไม่มีเจตนาให้ผู้ใช้งานทำสำเนางานอันมีลิขสิทธิ์ที่จะนำไปใช้งานได้แม้หลังจากการถ่ายทอดสัญญาณนั้นสิ้นสุดลงแล้ว การทำ Webcasting นั้นไม่รวมถึงบริการที่มีจุดมุ่งหมายเพื่อส่งเสริมการขายผลิตภัณฑ์หรือบริการใดๆ

• Webcasting On-Demand หมายถึง การส่งสัญญาณ (Streaming) ภาพและ/หรือเสียงงานอันมีลิขสิทธิ์ผ่านระบบอินเตอร์เน็ตซึ่งเป็นการถ่ายทอดสัญญาณงานลิขสิทธิ์โดยเฉพาะที่เกิดจากการร้องขอของผู้ใช้งาน ไม่ว่าจะเสียค่าใช้จ่ายหรือไม่ก็ตาม

• Downloading หมายถึง การส่งสัญญาณ (Streaming) ภาพและ/หรือเสียงงานอันมีลิขสิทธิ์ผ่านระบบอินเตอร์เน็ตซึ่งเป็นการถ่ายทอดสัญญาณงานลิขสิทธิ์โดยเฉพาะที่เกิดจากการร้องขอของผู้ใช้งาน โดยภาพและ/หรือเสียงนั้นถูกบันทึกลงบนเครื่องคอมพิวเตอร์หรืออุปกรณ์อื่นๆของผู้ใช้งาน

4. สิทธิในการ”ทำซ้ำ”เพื่อเผยแพร่ต่อสาธารณชน หมายถึง สิทธิในการทำซ้ำผลงานลิขสิทธิ์ลงบนคอมพิวเตอร์เซิร์ฟเวอร์ (Computer Server) ที่ใช้เผยแพร่ในสถานประกอบการต่างๆ เช่น ผับ, บาร์, คาราโอเกะ ฯลฯ

5. สิทธิอื่นๆ

• Mechanical Right หมายถึง การนำงานลิขสิทธิ์ไปบันทึกลงในสื่อชนิดใดก็ตาม เช่น ดิสก์ เทป ฯลฯ

• Synchronization Right หมายถึง การนำงานลิขสิทธิ์ไปเป็นเพลงประกอบภาพเคลื่อนไหว รวมถึงภาพยนตร์ โดยประสงค์จะนำไปฉายในโรงภาพยนตร์ หรือนำออกแพร่เสียงแพร่ภาพ หรืองานโสตทัศนวัสดุอื่นใด

Types of Copyrights (ประเภทของลิขสิทธิ์เพลง)


1. Communication to Public Rights

The right to do, or to authorize other persons to do any of the following acts:

• To perform the work in public (Public Performance) i.e. Restaurant, Pub, Bar, Lounge, Karaoke, Theater, Hotel, Fitness, Shop, Department Store, Spa, Dance School etc.

• To broadcast in Radio & Television i.e. Free T.V., Cable TV (Pay T.V.), Radio Station etc.

2. Mobile Service

• Ringtone

- Monophonic
- Polyphonic
- Truetone

• Ringback Tone / Calling Melody

3. Internet Service

• Simulcasting means the simultaneous unaltered transmission via the internet of sound recordings included in single channel and original free-to-air broadcasts of Radio and/or TV signals in compliance with the respective regulations on provision of broadcasting services.

• Webcasting means the streaming of Copyright Works via the Internet, where the primary purpose of the Licensee's service is to provide entertainment to Users on the authorized Website, and the streaming is done without the Licensee intending or enabling any member of the public to make any copies of the Copyright Works that would be useable after the transmission has ceased.

• Webcasting On-Demand means the transmission (streaming) of sound and/or picture signal of copyright subsisted work through Internet by which the transmission occur upon request of the user , with or without service fee.

• Downloading means the transmission (streaming) of sound and/or picture signal of copyright subsisted work through Internet by which the transmission occur upon request of the user where such picture and/or sound are recorded onto the computer or other devices of the user.

4. Reproduction for Communication to Public Rights means the reproduction of copyrights work into the computer servers for communication to the public such as Pub, Bar, Karaoke etc.

5. ETC.

• Mechanical Right means to make a record of the work, in the form of a disc, tape or any other form whatever.

• Synchronization Right means to record the work onto the soundtrack of a cinematograph including films intended for exhibitions in cinemas or for transmission by broadcasting or diffusion services, or of other audio visual productions.
