1. กิจการร่วมค้า: เอ็มซีที-โฟโนไรทส์ คือใคร? 

กิจการร่วมค้า เอ็มซีที-โฟโนไรทส์ (JV: MCT- Phonorights) จัดตั้งขึ้นในปี 2546 พื่อดูแลลิขสิทธิ์ให้แก่สมาชิกซึ่งเป็นนัก
แต่งเพลงไทย-เพลงสากล ผู้เป็นเจ้าของคำร้องทำนอง, บริษัทผู้ผลิตสิ่งบันทึกเสียง, ค่ายเพลงและผู้สร้างสรรค์ซึ่งเป็นสมาชิกทั่วโลก

กิจการร่วมค้า เอ็มซีที-โฟโนไรทส์ เกิดจากการประสานความร่วมมือระหว่างองค์กรจัดเก็บค่าลิขสิทธิ์ในเพลงสากล 2 องค์กร คือ

1.) องค์กรจัดเก็บค่าลิขสิทธิ์จากการเผยแพร่งานดนตรีกรรม คือบริษัท ลิขสิทธิ์ดนตรี (ประเทศไทย)จำกัด หรือ “MCT” จัดตั้งขึ้นในปี 2537 โดยเจ้าของลิขสิทธิ์ในงานดนตรีกรรม คือ ตัวแทนผู้ประพันธ์เพลง เจ้าของลิขสิทธิ์ในเนื้อร้อง ทำนองและเรียบเรียงเสียงประสานทั้งของไทยและต่างประเทศ ซึ่งเป็นสมาชิกของสมาพันธ์นักแต่งเพลงทั่วโลก (The International Confederation of Societies of Authors and Composers) หรือ CISAC และ

2.) องค์กรจัดเก็บค่าลิขสิทธิ์จากการเผยแพร่งานสิ่งบันทึกเสียง คือบริษัท โฟโนไรทส์ (ไทยแลนด์) จำกัด หรือ “Phonorights” เริ่มดำเนินการในปี 2540 โดยเจ้าของลิขสิทธิ์ในงานสิ่งบันทึกเสียง ได้แก่ ค่ายเพลงทั่วโลกกว่า 1,400 บริษัท ซึ่งเป็นสมาชิกของสมาพันธ์ผู้ผลิตสิ่งบันทึกเสียงระหว่างประเทศ (The Federation of Phonographic Industry) หรือ IFPI อาทิเช่น อีเอ็มไอ มิวสิค, โซนี่ บีเอ็มจี มิวสิค, ยูนิเวอร์ซัล มิวสิค และ วอร์นเนอร์ มิวสิค เป็นต้น

ปณิธานของกิจการร่วมค้าฯ

เป็นการประสานความร่วมมือจัดเก็บค่าลิขสิทธิ์ เพื่อตอบแทนเจ้าของลิขสิทธิ์อย่างเป็นธรรม โดยมีเป้าหมายสูงสุดเพื่อสนับสนุนความคิดสร้างสรรค์ของคนไทย

2. กิจการร่วมค้า: เอ็มซีที-โฟโนไรทส์ ทำอะไร?

กิจการร่วมค้า เอ็มซีที-โฟโนไรทส์ จะเป็นผู้ให้อนุญาตแก่บุคคลหรือธุรกิจใดก็ตามที่มีการนำเพลงของสมาชิกออกใช้งานและเผยแพร่ให้คนรับชมรับฟัง โดยการอำนวยความสะดวกให้แก่ผู้ประสงค์จะชำระค่าลิขสิทธิ์ โดยผู้รับอนุญาตสามารถขออนุญาตที่ JV: MCT Phonorights (One-stop) เพียงแห่งเดียวแต่ได้รับอนุญาตจากสมาชิกที่เป็นบริษัทค่ายเพลงและนักแต่งเพลงที่มีชื่อเสียงทั่วโลกนับแสนรายการ คิดเป็นสัดส่วนกว่า 90% ของบริษัทค่ายเพลงและนักแต่งเพลงทั้งหมดจากทั่วโลก

About Us

1. Who is JV: MCT – Phonorights (JV)?

“JV: MCT-Phonorights (JV)” is a non profit making organization formed in 2003 to license and control of its communication to the public right for members of two organizations namely MCT and Phonorights

1.) Music Copyright Thailand Limited (MCT) – the musical work’s copyright owner organization established in 1994, which represents international and Thai musical composers and authors for copyrighted musical work of its members and the members of some 30 affiliated foreign societies. MCT is a member of CISAC (The International Confederation of Societies of Authors and Composers).

2.) Phonorights (Thailand) Limited – the sound recording right owner organization established in 1997, which represent the sound recording work’s copyright owners over than 10,000 labels or 90% of all copyright owners of sound recording worldwide. Phonorights also work closely with The International Federation of Phonographic Industry (IFPI).

2. What does JV: MCT – Phonorights do?

JV: MCT-Phonorights (JV) grants licenses for any person or business that communicates the music of its members to the public. JV facilitates the music user to apply for licence at only one place for the convenience of the users such as broadcasters and commercial premises. Currently, JV has licensed Airline, radio stations, TV stations, hotels, restaurants, bars, pubs, disco, karaoke, etc. After cost deduction JV distribute all the royalty back to the copyright owners/holder.
